Rights and Obligations of the Seller

The Seller (Jiří Podrazil, Korunní street 129/1740, Prague 3, 130 00, IČO: 14963248, DIČ: CZ6204210320) is obliged:

  1. to process a binding order and send ordered photographs to the e-mail address stated in the Order form, eventually to save it on an FTP server (most orders will be processed the same day or the next day latest). The Seller will send along tax certificate which also serves as the certificate of warranty.
  2. to send out the photos on a CD or DVD if agreed upon with the Buyer
  3. to provide photographs in a professional digital print quality in format TIFF or JPG

The Seller has the following rights:

  1. To add to the price of goods also costs associated with packaging and shipping
  2. To decline an order of such client who did not take delivery or did not duly pay for ordered goods in the past

Rights and Obligations of the Buyer

The Buyer is obliged to provide complete and true information at each time of order and also agrees that by finalizing an order, it will be considered a binding one and will be processed by the Seller. A regular costumer paying via bank wire transfer agrees to pay for ordered and downloaded photographs by sending the price of the goods to the bank account of the Seller (acc. no. 151500395/0600) no later than the due date stated on the invoice.

Copyright

All photographs available for purchase on the ArchFoto.cz bank fall under the copyright, which belongs to the author of the photos, respectively the photobank representatives appointed to represent the authors. The use of any picture material is obliged by a license purchase and guided by the license agreement.

Protection of Personal Data

All personal data provided by the Buyer will be considered confidential in respect to Czech regulation 101/200 Sb. about personal data protection.

The Seller is obliged to use this personal information only for the purposes related to service provided by the ArchFoto.cz photo bank and not to disclose this information to a third party unless directly necessary for processing an order. The Seller agrees to delete any customer´s details from the client database upon written request from the particular customer.

License Agreement

License Agreement enclosed between the User of the License, the party using the photo based on this Agreement, and the photobank ArchFoto.cz (represented by Jiří Podrazil, IČO: 14963248, DIČ: CZ6204210320, with seat: Korunní street 129/1740, Prague 3, 130 00):

The License User accepts the following conditions of picture use given by the terms of this agreement.

  1. The photo bank ArchFoto.cz declares that it is the copyright owner of all presented photographs, eventually represents the authors of photographs. All images are meant for a one-time non-exclusive use. Under no means are these the subject of a sale. Every other use of the photograph is subject to a new license which must be in written form.
  2. A fee is paid by the User to the photo bank for every use of a photograph. The price for use of a particular photo is set by a calculation taking into consideration the format, method of use and edition. In case a User fails to pay for a License duly and in a timely matter, the License expires.
  3. This Agreement enables the User to use photos in personal, client or publisher projects in electronic or print form. The User is obliged to ensure that the photos will not be let out into the hands of a third party which does not have a License issued. This does not apply in case the third party is a client for whom the order is being executed. In case of a breach of the License Agreement (e.g. passing over of a photo to a third party), the User is obliged to pay a contractual fine in the amount of ten times the cost of the License). Entitlement to a compensation for damage done is not touched by this.
  4. ArchFoto.cz provides an image in a given appearance, format, resolution etc. The photo bank is not responsible neither to a License User nor any other person or company for any universal, direct or indirect or other damage resulting from the use of photographs (including any demand for compensation of a lost profit).
